TRAINING SERVICES AGREEMENT

The following guidelines apply to the Bay Club Company’s Professional Training program. Please review the following carefully and discuss any questions with your trainer or instructor.

CANCELLATIONS

All cancellations require a 24-hour advanced notice. In the event that 24-hour notice is not provided by the client, the client will be charged the full amount of the scheduled appointment.

PROMPTNESS

It is important for both client and trainer to arrive on time for a scheduled appointment. In the event the client is late, the trainer will wait one half the amount of time of the scheduled appointment. After that period, the trainer
is free from obligation and the client will be charged the full amount of the appointment.

EXPIRATION DATES

Package expiration dates are enforced. Extensions will only be approved with written Physician’s authorization.

  • Packages of 24 sessions or fewer expire within six months from the date of purchase.
  • Packages greater than 24 sessions expire one year from date of purchase.

REFUNDS

Generally, professional training sessions are non-refundable and credits are not provided. Refunds for unused sessions may only be given under extenuating circumstances such as illness or injury with a physician’s authorization, death, or a move outside of a 25-mile radius from any Bay Club location. All used sessions will be charged at the single session rate and a 15% administration fee will be charged for all approved package refunds.

APPOINTMENT VERIFICATION

A signature is required for every completed session.

SERVICES, FACILITIES, AND HOURS OF ACCESS

A description of the services provided under this agreement, facilities, and hours of access of the Club are available at www.bayclubs.com.

CONSUMER RIGHT TO CANCEL

You, the buyer, may, at a minimum, cancel this agreement at any time prior to midnight of the 20th business day of the Club after the date of this agreement, excluding Sundays and holidays. To cancel this agreement, mail or deliver a signed and dated notice, or send a telegram which states that you, the buyer, are canceling this agreement, or words of similar effect. The notice shall be sent via first-class mail, via email from an email address on file with the health studio, or delivered in person to:

If, however, you paid $2,001–$2,500 in fees for services, you have until midnight of the 30th business day, excluding Sundays and holidays, and if you paid greater than $2,500 in fees, you have until midnight of the 45th business day, excluding Sundays and holidays of the Club within which to cancel this agreement.
